51.02 Application for charging order

(1) A judgment creditor may apply to the Court for a charging order under section 22(13) of the Local Court (Civil Procedure) Act 1989 by filing:

(a)

a charging summons in accordance with Form 51A; and

(b)

an affidavit in support of the application.

(2) A judgment creditor may apply for a charging order without notice.

(3) When a registrar issues a charging summons, he or she must fix a date, time and place for the hearing of the application and mark them on the summons.
