51.04 Evidence in supporting affidavit
(1)
An affidavit in support of an application for a charging order is to:
(a)
state that the judgment debt is unsatisfied, either wholly or to a specified amount;
(b)
identify the securities in respect of which the charging order is sought and state in whose name they stand; and
(c)
state that the judgment debtor has a beneficial interest in the securities and describe that interest.
(2)
An affidavit under this rule may contain statements of fact based on information and belief if the grounds are set out.
