Ombudsman Act 2009

(1) For conducting the investigation, a Professional Standards Command member may direct a police officer to do 1 or more of the following:

(a) give information relevant to the investigation;

(b) produce a document or thing relevant to the investigation;

(c) answer a question relevant to the investigation.

(2) If the direction is given to the police officer whose conduct is under investigation, the Professional Standards Command member must inform the officer that:

(a) a complaint has been made about the officer's conduct and the nature of the complaint; and

(b) an investigation is being conducted into it.

(3) However, subsection (2) does not apply if the officer in charge of the

Professional Standards Command is satisfied informing the police officer may prejudice the conduct of the investigation.

(4) This section does not limit the powers or functions a police officer would have apart from this Act in relation to the investigation of an offence.
