12A Request to amend planning scheme
A person or body may request the Minister to amend a planning scheme.
The request must be in writing and include the following:
an explanation of the proposed amendment;
a statement of the purpose of the proposed amendment and its desired effect;
an assessment of the proposed amendment with respect to the matters to be considered by the Minister under section 13(1);
the details of any community consultation conducted, or to be conducted, in addition to the consultation required under this Act.
The Minister may require the person or body requesting an amendment to provide further information within a specified time if, in the Minister's opinion, additional information is necessary to enable a proper consideration of the request.
The Minister may reject the request without considering it further if:
the additional information is not provided within the time required; or
additional information is provided but the Minister considers it to be insufficient to enable a proper consideration of the request.
If the Minister rejects a request under subsection (4), the
Minister must give the person or body written notice of the rejection and the reasons for it.
