16 Notice relating to rezoning or grant of permit
This section applies in relation to land that will be affected by one of the following proposals if carried out:
a proposal to amend a planning scheme by establishing or changing a zone;
a proposal to grant or vary an exceptional development permit.
Subject to this section, on or before the first day of the period of exhibition for the proposal, the Minister must:
serve a notice on the owner of the land; and
arrange to be placed on or in the vicinity of the land as many signs, in accordance with subsections (4) and (5), as the Minister considers appropriate.
Subsection (2) does not apply if the Minister considers:
it is impracticable to comply with the subsection because of the location of the land or the number of parcels of land; and
it is reasonable to expect that all persons likely to be affected by the proposal will receive sufficient notice of it by means of the notice published under section 17.
A sign referred to in subsection (2)(b) must include the following information:
the current zone of the land;
the zone proposed for the land or the activity that will, despite the zone of the land, be permitted under an exceptional development permit.
A sign referred to in subsection (2)(b) must:
be placed on, or within a reasonable distance from, each public road frontage of the land; and
be clearly legible to a person from a location on the public road nearest to the land.
A person commits an offence if:
a sign is placed on land in accordance with this section; and
the person intentionally removes the sign; and
the removal occurred before the end of the period of exhibition for the proposal.
Maximum penalty: 100 penalty units.
Strict liability applies to subsection (6)(a) and (c).
