Planning Act 1999

After receiving an application under section 38, the Minister may decide:

to place the proposal in the application on exhibition;

if the proposal in the application is for a variation of a permit

– that the proposal is not so significant as to require exhibition;

or

to refuse to grant or vary the exceptional development permit without placing the proposal in the application on exhibition.

As soon as reasonably practicable after deciding to place a proposal on exhibition or to refuse to grant or vary the permit, the

Minister must give the applicant written notice of the decision.

If the Minister decides to place a proposal on exhibition, Part

2, Divisions 3, 4 and 5 apply in relation to the proposal.
