42 Matters to be taken into account when making decision
In deciding whether to grant or vary an exceptional development permit under section 40, the Minister must take into account the matters specified in section 51(1)(d), (h), (j), (k), (m), (n), (p),
, (r), (s) and (t).
If a proposal relating to the development or use of land is required to be referred to the NT EPA under Part 4, Division 3 of the
Environment Protection Act 2019, the Minister must not make a decision under section 40 in relation to the proposal unless:
the NT EPA has determined that an environmental impact assessment is not required under that Act for that proposal; or
if the NT EPA has determined that an environmental impact assessment is required – an environmental approval has been granted under that Act for the proposal and the decision is consistent with that approval; or
the Environment Protection Act 2019 otherwise permits the making of the decision.
