53C Notice of refusal
As soon as practicable after a consent authority determines a development application in accordance with section 53(c), the consent authority must serve a notice of refusal:
on the applicant; and
on any person (including a local government council) who made a submission in relation to the development application in accordance with section 49.
The notice of refusal must be in the approved form, containing the following information:
the determination of the consent authority;
the reasons for the determination;
particulars about the right of review under Part 9.
If there is a local government council for the land to which the development application relates, the consent authority must:
advise the local government council of the determination; and
provide the local government council with a copy of the reasons for the determination.
The consent authority must make available for inspection and purchase by the public a copy of the notice of refusal.
