33 Duty of health practitioner who takes sample
(1)
This section applies if a health practitioner takes a sample of a rail safety worker's blood for this Part.
(2)
The health practitioner must take the measures reasonably practicable in the circumstances to ensure the sample is not adulterated and does not deteriorate in a way that might prevent a proper assessment of the concentration of alcohol, or presence of a prohibited drug, by an analysis of the sample.
