35 Self-incrimination no excuse

A person is not entitled to refuse or fail to comply with a requirement or direction relating to the taking of a sample of the person's breath, oral fluid or blood under this Part or Part 3,

Division 9 of the Rail Safety National Law (NT) on the ground the person:

(a)

would or might, by complying with the requirement or direction, provide evidence that could be used against the person; or

(b)

consumed alcohol or a prohibited drug after the person last performed railway safety work and before the requirement or direction was made or given to him or her.
