45 Offences
Where a person commits an offence by reason of his refusal or failure to do an act that he is required under this Act to do:
that offence shall, for the purpose of paragraph (b), be deemed to continue so long as the person refuses or fails to do the act; and
if that person is convicted of the offence, then he commits a further offence against this Act on each day on which the offence is deemed to continue after the day on which he is so convicted and he is punishable in respect of each such further offence, upon conviction, by a maximum penalty of 0.8 penalty unit.
Proceedings for the conviction of a person, in respect of an offence against this Act may be instituted in the name of the
Commissioner .
