45P Benefit payable on death
(1)
If a member dies leaving a dependant or dependants, the NTGDIS benefit is payable to the estate of the deceased member.
(2)
However, if a benefit (a workers' compensation benefit) is payable in respect of the member's death to a dependant or dependants of the deceased member under workers' compensation legislation or a workers' compensation agreement, the NTGDIS benefit is to be reduced by the amount of the workers' compensation benefit.
(3)
If a workers' compensation benefit consists of periodic payments, the amount of the benefit is taken to be the notional redemption value (as determined by an approved actuary) of the periodic payments.
