43 Revocation of declaration as prohibited employer

(1)

A prohibited employer may apply to the CEO in the approved form requesting the CEO to revoke a declaration under section 40.

(2)

The CEO may completely revoke the declaration if the CEO is satisfied that the employer is no longer an unsuitable person to employ an apprentice or trainee.

(3)

The CEO may partly revoke the declaration if the CEO is satisfied that the employer is no longer an unsuitable person to employ an apprentice or trainee in a particular type of approved apprenticeship or approved traineeship.

(4)

If the CEO decides to completely revoke the declaration, the CEO must immediately give the employer written notice of the decision.

(5)

If the CEO decides to partly revoke the declaration or not to revoke the declaration, the CEO must immediately give the employer written notice of the decision, including the reasons for the decision.
