44 Prohibited employer not to contravene declaration

(1)

An employer commits an offence if:

(a)

a declaration is in force; and

(b)

the employer engages in conduct; and

(c)

the conduct results in a contravention of the declaration.

Maximum penalty: 100 penalty units.

(2) An offence against subsection (1) is an offence of strict liability.

(3) It is a defence to a prosecution for an offence against subsection (1) if the defendant has a reasonable excuse.

(4)

In this section:

declaration means:

(a)

a declaration made under section 40; or

(b) if the declaration has been partly revoked under section 43 – the declaration as partly revoked.
