40 Duration and renewal of licences
(1) Subject to this Act, a licence or a renewal of a licence remains in force for the period specified in it by the NT EPA.
An application for the renewal of a licence is to be:
(a) made to the NT EPA within the prescribed period before the licence expires;
in the approved form; and
accompanied by the prescribed fee (if any).
(3) The NT EPA may, on receipt of an application in accordance with subsection (2), renew a licence.
(4) A licence may be renewed subject to the conditions the NT EPA thinks fit, including but not limited to:
(a) the conditions specified on the licence as originally granted or last renewed; and
any other conditions specified in section 35 and 36.
In determining:
whether to renew a licence; and
(b) the conditions, if any, to be placed on a licence that is to be renewed,
the NT EPA is to have regard to the matters it thinks fit including, but not limited to:
(c) whether the holder of the licence has contravened or failed to comply with a provision of this Act;
(d) the extent to which the holder of the licence has complied with a pollution abatement notice issued to him or her;
(e) the extent to which the holder of the licence has complied with the lawful directions of an authorised officer;
the matters specified in section 32(1); and
(g) in the case of a best practice licence – the matters specified in section 33.
