Part 6Interlocutory application

6.05 Service

(1)

The applicant must serve a sealed copy of the interlocutory application and, if applicable, a copy of the supporting affidavit on each party to whom the application is addressed.

(2)

Subject to these Rules, an interlocutory application and supporting affidavit must be served:

(a)

within a reasonable time before the date fixed for the hearing and, in any case, not later than 2.00 p.m. on the day before the date fixed for the hearing; or

(b)

if the registry is closed on the day before the date fixed for the hearing – not later than 2.00 p.m. on the day the registry is last open before that date.
