74 Deeds of grant to be prepared

(1)

If—

(a)

the Land Tribunal recommends to the Minister that an area of land be granted in fee simple to a group of Aboriginal people; and

(b)

the Minister is satisfied that the land, or a part of the land, should be so granted to the group;

the Minister must direct the chief executive to prepare a deed of grant in fee simple over the land or that part of the land.

(2)

The land need not be surveyed but may be described in the deed of grant in such manner as the Minister directs.

(3)

The deed of grant must show that the land is held by the grantees for the benefit of the group of Aboriginal people and their ancestors and descendants.

(4)

The deed of grant must specify—

(a)

the ground on which the Land Tribunal recommended that the land be granted; and

(b)

the responsibilities that the group of Aboriginal people have agreed to assume in relation to the land.

(5)

Subsections (2), (3) and (4) have effect despite any other Act or any rule of law or practice.
