Conditions of aerial distribution contractor licence
17B Conditions of aerial distribution contractor licence
An aerial distribution contractor licence is subject to the following conditions—
the licensee must hold a civil aviation authorisation—
if a manned aircraft is being used under the licence to carry out aerial distribution—that is an AOC under which the aircraft may operate in Australian territory for commercial purposes that are the distribution of agricultural chemicals; and
if a UAV is being used under the licence to carry out aerial distribution—under which the licensee may operate for hire or reward the UAV in the circumstances the aerial distribution is being carried out;
any reasonable conditions, imposed by the chief executive, that the chief executive considers appropriate for the proper control of aerial distribution carried out under the licence.
The chief executive may impose a condition under subsection (1)(b)—
when the licence is issued or renewed; or
at another time if the chief executive considers there is a risk relating to the licence that warrants the condition being imposed at that time.
If the chief executive decides to impose a condition on the licence under subsection (2)(b), the chief executive must, as soon as practicable, give the licensee an information notice for the decision.
