Giving test sample
42 Giving test sample
The chief executive or a health practitioner may give a prisoner or an offender mentioned in section 41(1)(b) directions about the way the prisoner or offender must give a test sample.
Only a health practitioner may take a sample of blood.
A health practitioner, and anyone acting in good faith at the direction of the health practitioner, may use the force that is reasonably necessary to enable the health practitioner to take the test sample.
A regulation may prescribe—
the number of corrective services officers that must be present when a test sample stated in the regulation is being taken from a prisoner; and
how a test sample stated in the regulation, other than a sample of blood, must be taken.
