Duties Act 2001

An instrument mentioned in subsection (2) that provides for the transfer of matrimonial property from 1 party to a marriage to only the other party to the marriage is a matrimonial instrument on the dissolution or annulment of the marriage.

For subsection (1), the instruments are the following—

an agreement registered or approved under the Family Law Act 1975 (Cwlth);

an order of a court under the Family Law Act 1975 (Cwlth);

an instrument made under an instrument mentioned in paragraph (a) or (b);

an instrument made after the start of a proceeding for the dissolution or annulment of the marriage.
