For section 75, a qualified holder is taken to hold the units in a unit trust held for the holder by a custodian.

For section 75(1)(b) and (c)—

a trustee of a complying superannuation fund that has invested in a pooled superannuation trust is taken to hold the number of units in a unit trust held by the trustee of the pooled superannuation trust that is worked out by applying the fund’s interest in the pooled superannuation trust to the units held by the trustee; and

a member of a pooled public investment unit trust is taken to hold the number of units in a unit trust held by the trustee of the pooled public investment unit trust that is worked out by applying the member’s interest in the pooled public investment unit trust to the units held by the trustee.

For subsection (2)(a), a complying superannuation fund’s interest in a pooled superannuation trust is the proportion that the fund’s investment bears to the total of all investments in the trust expressed as a percentage.

For subsection (2)(b), a member’s interest in a pooled public investment unit trust is the proportion that the value of the member’s entitlement as a member bears to the value of the entitlements of all members in the trust expressed as a percentage.
