Electoral Act 1992

As soon as practicable after noon on the cut-off day for nominations, the commission must advise the returning officer for each electoral district of the names of all persons properly nominated to the commission for election for the district.

As soon as practicable after advice is received from the commission, each returning officer must arrange for a notice stating the names of the persons properly nominated for election to the electoral district to be—

displayed in a conspicuous place at the returning officer’s office; and

published in such ways as the returning officer considers appropriate.

On the display of the names at the returning officer’s office, the persons become candidates for the election for the electoral district.

A person is properly nominated for election for the purposes of this section if—

the provisions of this division relating to nomination have been complied with or, if there is a formal defect or error in the nomination, the provisions have been substantially complied with; and

neither section 91 nor 92 applies to the person’s nomination.
