(1)

This section applies if, immediately before the commencement of this section, an environmental offset condition required a person to make a monetary payment to an environmental offset trust and the payment had not been made.

(2)

Despite the repeal of section 209(2) by the Environmental Offsets Act 2014, the person is still required to make the payment.

(3)

However, the payment is to be made to the offset account under that Act instead of to an environmental offset trust.
