145D Fires in State forests etc.
The provisions of this part do not apply to the lighting of a fire—
in a protected area by a person acting in the performance of duties under the Nature Conservation Act 1992; or
in a State forest, timber reserve or forest entitlement area by a person acting in the performance of duties under the Forestry Act 1959.
The commissioner must not authorise the lighting of fires—
in a protected area without the approval of the chief executive of the department that deals with matters arising under the Nature Conservation Act 1992; or
in a State forest (other than a licence area), timber reserve or forest entitlement area without the approval of the chief executive of the department that deals with matters arising under the Forestry Act 1959.
For subsection (1)(b), a person acting in the performance of duties under the Forestry Act 1959 does not include—
a plantation operator; or
a plantation officer.
