228 Fixing of prices
Subject to section 228A, the Minister may fix any or all of the following—
standing offer prices of a retailer for or relating to the sale of a covered gas to a customer;
charges relating to the sale of a covered gas to a customer;
a methodology to fix the standing offer prices or charges.
Examples of matters for which prices, charges or a methodology may be fixed—
• charges for selling a covered gas
• charges or fees for late or dishonoured payments
• charges or fees for discontinuing or recommencing the sale of a covered gas
In exercising the power, the Minister must consider the main purposes of this Act and the QCA code objective.
The prices, or prices fixed under the methodology, are called notified prices.
The notified prices, or methodology to fix the prices—
must be notified by gazette notice; and
take effect on the later of the following days—
the day the notice is gazetted;
if the gazette notice states a later day of effect—the later day.
In this section—retailer means a retailer under the NERL (Qld).standing offer prices has the meaning given by the NERL (Qld), section 2.
Note—
Under section 320, the Minister may delegate the Minister’s powers under this division to QCA.
