38 Basis for appointment
The Minister may make the appointment only if—
(a)
the board asks the Minister to make the appointment; or
(b)
the board is given a show cause notice under the Education (Accreditation of Non-State Schools) Act 2017, section 67; or
(c)
the Minister reasonably believes the school is no longer financially viable or is in danger of becoming financially non-viable.
