13 Police officer to give bench charge sheet to clerk of the court

(1)

This section applies to a charge against a defendant if—

(a)

the charge is of an offence for which a proceeding may be brought under the Act; and

(b)

the defendant is—

(i)

arrested on the charge, with or without a warrant; or

(ii)

served with a notice to appear under the Police Powers and Responsibilities Act 2000 for the offence.

(2)

However, this section does not apply to a charge for which a bench charge sheet is required under an Act other than the Act.

(3)

A police officer must give the clerk of the court of the relevant court a separate bench charge sheet for each charge to which this section applies.

(4)

The bench charge sheet may be given electronically to the clerk of the court.

(5)

In this section—

relevant court, for a charge against a defendant, means a court before which the defendant is to be brought on the charge.
