52B Application of Act
The following provisions of this Act apply to the Land Court in the performance of a function conferred on the court under a recommendatory provision, with all necessary changes, as if the performance of the function under the recommendatory provision were a proceeding—
section 5;
section 7A(2)(a) and (c) and (3);
section 9;
section 12A;
section 16;
section 22;
section 24;
section 25;
section 27;
section 27B;
section 27C, other than to the extent the Civil Proceedings Act 2011, part 6 refers to case appraisal;
section 42;
section 46;
section 52.
For subsection (1), section 27C applies to the Land Court in the performance of a function mentioned in the subsection as if a reference in section 27C(2) to section 27A were a reference to section 52C.
Sections 32A, 32C and 32D of this Act apply to the Land Court in the performance of a function conferred on the court under the following recommendatory provisions, with all necessary changes, as if the performance of the function under the recommendatory provision were a proceeding—
the Aboriginal Cultural Heritage Act 2003, part 6, division 5 and part 7, division 6;
the Torres Strait Islander Cultural Heritage Act 2003, part 6, division 5 and part 7, division 6.
In this section—performance, of a function, includes the exercise of a power.
