34 Land Act tenures

(1)

This section applies for a Land Act rental valuation.

(2)

However, this section applies only if, under the conditions of the Land Act tenure, the land may be used other than just as a single dwelling house or for farming.

Note—

If the use is so restricted, see division 5, subdivision 2 (Exclusive use as a single dwelling house or for farming).

(3)

If the land is not used for farming, the physical state and condition of the land at the start of the Land Act tenure must be considered in deciding the land’s value.

(4)

However, the value must not include any of the following as defined under the Land Act, schedule 6—

(a)

improvements on the land;

(b)

development works done to the land since the Land Act tenure commenced.
