Legislative Standards Act 1992

This section applies if an officer of the public service is appointed as the parliamentary counsel.

The person retains and is entitled to all rights that have accrued to the person because of employment as such an officer, or that would accrue in the future to the person because of that employment, as if service as parliamentary counsel were a continuation of service as an officer of the public service.

At the end of the person’s term of office or on resignation—

the person is entitled to be appointed to an office in the public service at a salary level not less than the current salary level of an office equivalent to the office the person held before being appointed as parliamentary counsel; and

the person’s service as parliamentary counsel is to be regarded as service of a like nature in the public service for the purpose of determining the person’s rights as an officer of the public service.
