Decision about withdrawing approval of relevant agreement
139D Decision about withdrawing approval of relevant agreement
After considering any representations made by the licensee, lessee, sublessee, franchisee or manager, the commissioner—
if the commissioner is satisfied of the matter mentioned in section 139C(1)—must withdraw the commissioner’s approval; or
may take no further action about the show cause notice.
If the commissioner withdraws the approval under subsection (1)(a), the commissioner must give the licensee written notice of the withdrawal and direct the licensee to terminate the relevant agreement with the lessee, sublessee, franchisee or manager by stating in the notice—
the approval has been withdrawn under this section; and
that the licensee must terminate the agreement within the time stated in the notice.
The written notice must comply with the tribunal Act, section 157(2).
A copy of the notice must be given to the lessee, sublessee, franchisee or manager under the relevant agreement.
The withdrawal under subsection (1)(a) takes effect when the notice is given to the licensee under subsection (2).
