Liquor Act 1992

The commissioner may decide that liquor may be sold under the authority of a nightclub licence for consumption off the licensed premises only if the commissioner is satisfied the sale of liquor will be made only in the course of the licensee providing catering facilities for functions.

The authority conferred by a nightclub licence to sell liquor for consumption off the licensed premises is restricted to the sale of liquor—

as ancillary to a function that—

happens at a place at which the liquor is consumed; and

includes the licensee providing food for the function of sufficient substance as to be ordinarily accepted as a meal for consumption by persons genuinely attending the function, even though the food may be eaten while standing and without cutlery; and

for consumption by persons genuinely attending the function.
