39 Making recommendation for assessment
(1)
A doctor or authorised mental health practitioner may, after examining a person under section 31, make a recommendation for assessment for the person if satisfied—
(a)
the treatment criteria may apply to the person; and
(b)
there appears to be no less restrictive way for the person to receive treatment and care for the person’s mental illness.
(2)
The recommendation for assessment must be made within 7 days after the examination.
(3)
The recommendation for assessment must be in the approved form.
