Continuation of mining lease while application being dealt with
286C Continuation of mining lease while application being dealt with
This section applies if the term (the previous term) of a mining lease ends before an application for renewal of the mining lease is decided.
Despite the ending of the previous term, the mining lease continues in effect until the earlier of the following to happen—
the start of any renewed term of the lease;
a refusal of the application takes effect;
the application is withdrawn;
the lease is cancelled under this Act.
If the mining lease is a prescribed mineral mining lease, the lease is taken to have a development plan—
while the lease continues in effect under subsection (2); and
even if the plan period for the current development plan ends.
If the mining lease is renewed, subsection (2) is taken never to have applied in the period starting at the end of the previous term of the lease and ending on the renewal of the lease.
