Penalties and Sentences Act 1992

This section applies to a person who—

is a member of the community justice group in an offender’s community; and

is responsible for the making of a submission about the offender to a court under section 9(2)(p).

For subsection (1)(b), it does not matter that the person did not personally make the submission to the court.

The person is not civilly liable for an act done, or an omission made, honestly and without negligence in relation to the making of the submission.
