Deciding action to be taken

Current

(1)

The commissioner must consider all submissions made during the show cause period and decide to—

(a)

take no disciplinary action against the licensee; or

(b)

take disciplinary action against the licensee.

(2)

However, subsection (3) applies if the commissioner is satisfied—

(a)

a ground exists to take disciplinary action against a licensee under section 49; and

(b)

it would be reasonable in the circumstances to—

(i)

suspend the licensee’s licence for more than 1 year; or

(ii)

cancel the licensee’s licence.

(3)

The commissioner must refer the matter, as provided under the QCAT Act, to QCAT to decide whether or not to make an order against the licensee in relation to the matter.
