224 Contravention of s 221 or 223
This section applies to a person who contravenes section 221 or 223 (a relevant section).
The person is liable to—
for a first offence—a maximum penalty of 600 penalty units or 1 year’s imprisonment; or
for a second offence—a maximum penalty of 1,200 penalty units or 2 years imprisonment; or
for a third or subsequent offence—a maximum penalty of 4,000 penalty units or 5 years imprisonment.
A person is liable for the penalty under this section—
for a second offence—if the person has been convicted of a single offence against a relevant section or a repealed provision; or
for a third or subsequent offence—if the person has been convicted of 2 or more offences against a relevant section or a repealed provision.
In this section—repealed provision means—
the Racing Act, repealed section 321 or 323; or
the repealed Racing and Betting Act 1980, section 214, 216 or 217.
