14 Meaning of agency
In this Act, an agency means—
a department; or
a local government; or
a public authority; or
a government owned corporation;
or
a subsidiary of a government owned corporation.
However, in this Act, agency does not include an entity to which this Act does not apply.
Note—

For this Act—
a board, council, committee, subcommittee or other body established by government to help, or to perform functions connected with, an agency is not a separate agency, but is taken to be comprised within the agency; and
without limiting paragraph (a) and to remove any doubt, it is declared that a school council is not a separate agency, but is taken to be comprised within the department in which the Education (General Provisions) Act 2006 is administered; and
a reference to an agency includes a reference to a body that is taken to be comprised within the agency.
In this section—
school council means a school council established under the Education (General Provisions) Act 2006, section 79.
