35 Review of decisions

(1)

The table in applied WHS schedule 2A (other than to the extent to which it relates to section 102 of the Work Health and Safety Act 2011) states—

(a)

decisions made under this Act that are reviewable under this part (reviewable decisions); and

(b)

who is eligible to apply for review of a reviewable decision (the eligible person).

(2)

Jurisdiction is conferred on QCAT to hear and decide an external review relating to a reviewable decision.

(3)

The Work Health and Safety Act 2011, part 12 (other than section 223(1)) and schedule 2A (as provided under subsection (1)) apply for this Act as if—

(a)

a reference in those provisions, other than in applied WHS section 224, to an internal review were a reference to an internal review as defined under applied WHS section 224; and

(b)

a reference in those provisions to a reviewable decision or eligible person were a reference to a reviewable decision or eligible person under subsection (1).

(4)

In this section—

external review means an external review as defined under applied WHS section 229.
