152 Noncompliance with fencing notice or obligation to maintain fence

(1)

This section applies if the landowner does not—

(a)

comply with the fencing notice; or

(b)

maintain the fence in a stock-proof condition.

(2)

The chief executive officer of the local government may enter the owner’s land at any reasonable time to build or complete the building of the fence, or do anything necessary to make the fence stock-proof.

(3)

Before entering the owner’s land, the chief executive officer must give the owner at least 7 days written notice stating the following—

(a)

that the chief executive officer intends to enter the land;

(b)

the purpose of the intended entry;

(c)

the date of the intended entry;

(d)

the intended stay.
