161 Overgrazing on stock route network

(1)

This section applies if the chief executive officer of a local government reasonably believes, because of the number of stock on land within which a part of the network in the local government’s area is fenced or otherwise enclosed, sufficient pasture will not be available for travelling stock on the network.

(2)

The local government may, by written notice given to the landowner, require the owner to reduce the number of stock on the land.

(3)

The notice must—

(a)

state the reasonable number to which the stock are to be reduced and the reasonable period in which the reduction must be made; and

(b)

be accompanied by or include an information notice for the decision to give the notice.

(4)

The owner must comply with the notice unless the owner has a reasonable excuse.Maximum penalty—400 penalty units.

(5)

This section does not limit the chief executive officer’s powers under section 149.
