Protection from liability etc.

In force

(1)

This section applies to the following persons—

(a)

the PIM;

(b)

a deputy PIM;

(c)

a parliamentary commissioner officer;

(d)

a legal practitioner mentioned in section 32(1).

(2)

The person does not incur civil liability for an act done, or omission made, honestly and without negligence under this Act.

(3)

If subsection (2) prevents a civil liability attaching to a person, the liability instead attaches to the State.

(4)

The person may not be called to give evidence or produce any document in any court, or in any judicial proceedings, in relation to any matter coming to the person’s knowledge while performing functions under this Act.

(5)

In this section—

parliamentary commissioner officer means—

(a)

the parliamentary commissioner; or

(b)

an officer or employee of the parliamentary service assigned to the parliamentary commissioner; or

(c)

a person engaged to provide the parliamentary commissioner with services, information or advice.
