Division 3General powers of authorised officers after entering places

97 General powers

(1)

The authorised officer may do any of the following—

(a)

search any part of the place;

(b)

inspect, examine or film any part of the place or anything at the place;

(c)

take for examination a thing, or a sample of or from a thing, at the place;

(d)

take an extract from, or copy, a document at the place, or take the document to another place to copy;

(e)

produce an image or writing from an electronic document at the place or, to the extent that is not practicable, take either or both of the following to another place to produce an image or writing from an electronic document—

(i)

a thing containing an electronic document;

(ii)

a thing that can be used to produce an image or writing from an electronic document;

(f)

take to, into or onto the place and use any person, equipment and materials the authorised officer requires for exercising the officer’s powers under this part;

(g)

remain at the place for the time necessary to achieve the purpose of the entry.

(2)

The authorised officer may do anything necessary to exercise a power under subsection (1).

(3)

If the authorised officer takes a document from the place to copy it, the authorised officer must copy the document and return it to the place as soon as practicable.

(4)

If the authorised officer takes a thing from the place to produce an image or writing from an electronic document, the authorised officer must produce the image or writing from the document and return the thing to the place as soon as practicable.

(5)

In this section—

examine includes analyse, test, account for, measure, weigh, grade, gauge and identify.

film includes photograph, videotape and record an image in another way.

inspect, a thing, includes open the thing and examine its contents.
