105T Liability for damage caused by failure to comply with request for information
(1)
This section applies if—
(a)
a local government causes damage to public utility plant located on local government tollway corridor land; and
(b)
before the damage was caused, the local government had asked for information as mentioned in section 105S(2) from the public utility provider owning the public utility plant; and
(c)
the public utility provider had not, within a reasonable time, complied with the request; and
(d)
the damage was caused because of the failure to comply with the request.
(2)
Unless the local government otherwise agrees, the local government is not liable for the damage.
