Obstruction of authorised person

(1)

A person must not obstruct an authorised person, in relation to the authorised person’s exercise of a power under this division, unless the person has a reasonable excuse.

Maximum penalty—20 penalty units.

(2)

If a person has obstructed an authorised person and the authorised person decides to proceed with the exercise of the power, the authorised person must warn the person that—

(a)

it is an offence to obstruct the authorised person unless the person has a reasonable excuse; and

(b)

the authorised person reasonably believes the person’s conduct is an obstruction.

(3)

In this section—

obstruct includes assault, hinder, resist and attempt or threaten to obstruct.
