104 Duty of rail operators
A rail operator must not use a rail vehicle to transport dangerous goods if the rail operator knows, or ought reasonably to know, that—
(a)
the vehicle is, in the same journey, transporting goods that are incompatible with the dangerous goods; and
(b)
the dangerous goods are not segregated from the incompatible goods in accordance with either—
(i)
part 9 of the ADG Code; or
(ii)
an approval under section 106.
Maximum penalty—40 penalty units.
