126 Duties of prime contractors

(1)

A prime contractor must not permit a person to drive a rail vehicle used by the prime contractor to transport dangerous goods if the person has not been given transport documentation complying with chapter 11.1 of the ADG Code for the goods.Maximum penalty—40 penalty units.

(2)

For subsection (1), the person is to be taken to have been given the transport documentation if the contents of the documentation have been communicated to the person by means of electronic data processing or electronic data interchange.

(3)

Also, the prime contractor must—

(a)

keep the transport documentation, or a copy of the documentation, in a legible form for at least 3 months after the prime contractor transports the goods; and

(b)

produce the documentation or copy during the 3 months if asked by an authorised person.

Maximum penalty—40 penalty units.
