152 Recommendations by chief executive

(1)

This section applies if the chief executive considers that a ground exists for a dangerous goods authority to do any of the following (the proposed action)—

(a)

amend or cancel a corresponding determination;

(b)

amend or cancel a corresponding approval or corresponding exemption.

(2)

The chief executive may recommend, in writing, that the dangerous goods authority take the proposed action.

(3)

The chief executive must provide written reasons to the dangerous goods authority for the recommendation.

(4)

If the recommendation is about a corresponding determination (other than a corresponding administrative determination), corresponding approval or corresponding exemption that has effect in 1 or more other participating jurisdictions, the chief executive must also refer the recommendation to the competent authorities panel.

(5)

In this section—

corresponding administrative determination means a corresponding determination—

(a)

made by a dangerous goods authority on the application of a person; and

(b)

that applies to the person or the person and other persons named in the application.
