188 Continuing effect of particular approvals

(1)

This section applies to an approval that—

(a)

was given under the repealed regulation; and

(b)

was in force in this jurisdiction immediately before the commencement; and

(c)

is an approval of something that may be approved under a provision (the relevant provision) of any of the following sections—

(i)

section 46;

(ii)

section 49;

(iii)

section 106;

(iv)

section 107;

(v)

section 110;

(vi)

section 134.

(2)

This section also applies to an approval, given under the repealed regulation following a review under subdivision 9, that is an approval of something that may be approved under a provision (the relevant provision) mentioned in subsection (1)(c).

(3)

The approval is taken to be an approval given by the chief executive under the relevant provision subject to the same conditions and restrictions.

(4)

To remove any doubt, it is declared that the approval was given when it was given under the repealed regulation.

(5)

Without limiting subsection (3), the chief executive may record the approval in the register of approvals kept under section 172(1)(a).

(6)

If the approval does not have an expiry day, the approval expires 5 years after the commencement.
