229 Air conditioning in buses—obligations of operator
If the operator of a public passenger service uses a bus fitted with an air conditioner to provide a general route service or school service, the operator must—
ensure the air conditioner is fully operational and in good repair; and
if the maximum daily air temperature forecast by the Bureau of Meteorology for the area where the general route service or school service operates is at least 28ºC—instruct the driver to turn on the air conditioner.
Maximum penalty—20 penalty units.
The operator does not commit an offence against subsection (1)(a) in relation to the use of a bus fitted with an air conditioner that is not fully operational because it requires maintenance or repair if, after first becoming aware that the air conditioner is not fully operational—
the operator takes reasonable steps to have the air conditioner maintained or repaired as quickly as possible; and
the operator makes a written record of—
the date the air conditioner stopped being fully operational or in good repair; and
the steps taken to have the air conditioner maintained or repaired as quickly as possible; and
the operator displays a sign in a conspicuous position near the entry to the bus that informs the passengers that the air conditioner is not fully operational because it requires maintenance or repair.
